Nothing in these Terms limits any mandatory consumer rights that apply under Danish or EU law.
2. Products
Modlabs sells performance components and parts intended primarily for custom electric scooter and electric vehicle projects.
Product specifications, dimensions, compatibility information, winding options, voltage ratings and other technical information are provided as accurately as reasonably possible.
Because many Modlabs products are intended for custom builds, compatibility cannot be guaranteed unless explicitly stated. The customer is responsible for verifying dimensions, electrical compatibility, mechanical compatibility and suitability for their intended application before installation.
Customers may contact Modlabs before ordering if they are unsure about compatibility.
3. High-Performance Components and Legal Use
Some products sold by Modlabs are capable of substantially increasing the power or performance of a vehicle.
The sale of a component does not mean that a vehicle fitted with that component is approved for use on public roads.
The customer is responsible for complying with all laws, regulations, registration requirements, insurance requirements and vehicle rules applicable in their country or region.
Products intended for high-performance applications should only be installed and operated by persons with appropriate technical knowledge.
4. Installation and Safety
High-power motors, controllers, batteries and associated components can involve significant electrical, mechanical and thermal loads.
Incorrect installation or configuration may result in component failure, property damage or personal injury.
Customers are responsible for ensuring that components are installed correctly and that the complete vehicle is mechanically and electrically suitable for the power level used.
Where appropriate, installation should be performed or inspected by a competent person.
Modlabs is not responsible for damage caused by incorrect installation, incompatible components, incorrect configuration, modification, misuse or operation outside the product's stated specifications, except where liability cannot legally be excluded.
5. Prices
All prices are displayed in the currency shown on the website.
Applicable taxes are calculated according to the customer's location and the tax treatment shown during checkout.
Shipping costs, where applicable, are displayed separately before the customer completes the purchase.
We reserve the right to change prices at any time. A price change will not affect an order that has already been accepted.
In the event of an obvious pricing or technical error, we may cancel the affected order and refund any payment already received, to the extent permitted by applicable law.
6. Orders
After placing an order, the customer will receive an electronic order confirmation.
We may contact the customer if additional information is required to fulfil an order.
We reserve the right to refuse or cancel an order where reasonably necessary, including cases involving suspected fraud, incorrect pricing, unavailable products or delivery restrictions.
If an order that has already been paid for is cancelled by Modlabs, the customer will receive a refund of the amount paid for the cancelled items.
7. Payment
Available payment methods are displayed at checkout.
Payment processing may be performed by third-party payment providers. The customer may therefore also be subject to the relevant payment provider's terms.
Modlabs does not store complete payment-card information.
8. Shipping and Delivery
Available shipping methods and prices are displayed during checkout where applicable.
Delivery estimates are estimates and may vary depending on destination, carrier, customs processing and product availability.
Customers are responsible for providing a complete and accurate delivery address.
For shipments outside the European Union, the customer may be responsible for import duties, customs charges and local taxes unless explicitly stated otherwise during checkout.
Further details are available in our Shipping Policy.
9. Right of Withdrawal and Returns
Consumers purchasing online normally have a 14-day right of withdrawal under Danish/EU consumer rules.
The withdrawal period generally begins when the customer receives the goods.
Customers wishing to exercise their right of withdrawal must notify Modlabs within the applicable withdrawal period.
Unless otherwise required by law, the customer is responsible for the direct cost of returning a product when exercising the ordinary right of withdrawal.
Returned products may be inspected for handling beyond what is necessary to determine their nature, characteristics and function.
Full conditions and instructions are described in our Refund Policy.
These terms do not affect the customer's statutory rights concerning defective products.
10. Defective Products and Consumer Rights
For consumer purchases covered by Danish law, customers generally have a 2-year statutory right to complain about defects in goods where the defect or its cause existed when the product was delivered.
A statutory claim is separate from any voluntary manufacturer's warranty.
Damage caused after delivery by incorrect installation, accidents, misuse, excessive loads, incompatible components, modification or use outside the product's intended specifications is not automatically considered a product defect.
Nothing in these Terms removes rights granted to consumers by mandatory consumer-protection legislation.
11. Product Modifications
Modification of a product may affect warranty or statutory defect claims where the modification caused or contributed to the reported problem.
Examples may include disassembly, machining, rewiring, incorrect soldering, modification of motor internals or operation substantially outside stated specifications.
This does not remove statutory consumer rights for defects unrelated to the modification.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Modlabs is not responsible for indirect losses resulting from improper installation, unsafe operation, incompatible components or unlawful use of products.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
13. Intellectual Property
The Modlabs name, logo, website design, original photographs, descriptions, graphics and other original website content may not be reproduced or commercially used without permission, except where permitted by law.
Third-party product names and trademarks remain the property of their respective owners.
14. Privacy
Personal information is processed in accordance with our Privacy Policy and applicable data-protection legislation.
Information necessary to process an order may be shared with service providers such as payment processors, shipping carriers and fulfilment providers where necessary to complete the transaction.
15. Governing Law
These Terms are governed by Danish law.
If the customer is a consumer residing in another country, this choice of law does not deprive the customer of mandatory consumer protections that apply to them under applicable law.
Disputes should first be raised with Modlabs so that we have an opportunity to resolve the matter directly.
16. Changes to These Terms
Modlabs may update these Terms of Service when necessary.
The version applicable to a purchase is normally the version in effect when the order was placed.
